After a collision with a drunk driver, a two-year old girl was left with severe brain damage. The innocent owner of the truck that the drunk driver was driving was left unprotected by his insurance company. USAA did not pay their policy limits and protect their insured. Because of USAA's failure, a multimillion-dollar judgment was entered against the innocent owner. The firm represented the innocent owner in an action against USAA. Ricci~Leopold, P.A. argued that USAA had an opportunity to settle the case and obtain a release for the owner for its policy limits. USAA contended that they and the insured made a "mutual mistake" when the policy was drafted. That issue was litigated all the way to the Florida Supreme Court. USAA lost. Ricci~Leopold, P.A. successfully fought USAA. Ultimately the case settled in favor of the insured. |
