For more than 20 years, the U.S. government has supported a policy of highway forgiveness, which means the highways on which we drive should be designed, constructed and maintained to ensure our safety. A street, highway, bridge, road shoulder, exit ramp, guardrail, utility pole, etc. can be defectively designed, poorly constructed and improperly maintained. When these defects contribute to or are the primary cause of an accident, the injured party can seek legal restitution from the corporation, governmental bodies or individuals responsible for that roadway.
