Firm Wins $1.3 million for Elderly CoupleSerlin v. Colonial Penn Insurance Company
The firm won summary judgment and a settlement of more than $1.3 million for a couple in their 80s who were denied coverage by Colonial Penn Insurance Co. Colonial Penn, which specializes in selling insurance to senior citizens, excluded uninsured motorist coverage for passengers from its Florida umbrella policies. The Ricci firm sought an order from the Palm Beach County Circuit Court that such an exclusion violated Florida's public policy. The court agreed. "There may be thousands of elderly Floridians who have these policies and who are paying for coverage that is actually excluded," said Ms. McMillan, who was assisted by Lois Frankel, Ed Ricci and Joe Vaccaro.
Lawrence Serlin, 85, and his wife, Florence, 82, were passengers in the rear seat of a car when the uninsured driver of a stolen vehicle traveling 80 mph rammed the car and critically injured the Serlins. The Ricci firm won summary judgment and a settlement of more than $1.3 million for the Serlins. |
