Daimler Chrysler and Phil Smith Chrysler-Plymouth named in South Florida lawsuit where two men die due to defective Jeep vehicleChristmas Eve is a time when most families come together in celebration and joy, however the family of Kenneth Tulloch mourns at this time of the year due to his untimely and senseless death - caused by a defective Daimler Chrysler built Jeep vehicle. Kenneth Tulloch was a passenger in a Jeep Cherokee driven by Wadim Mishalow an employee of Seaboard Marine, Ltd., Inc. Mishalow was operating the vehicle within the scope of his work for Seaboard on the grounds of the Port of Miami. Suddenly and unexpectedly the vehicle accelerated and plunged over a seawall at the Port. Both men died as a result of the defective Chrysler-Jeep vehicle. Attorneys, Edward M. Ricci and Theodore J. Leopold partners of the law firm of Ricci~Leopold have filed suit on behalf of Kenneth Tulloch's family including his wife Zensi and dependent children Jharred and Jodi. The suit names Chrysler Corporation, Daimler Chrysler Corporation, Phil Smith Chrysler-Plymouth, Jeep Eagle Automotive and Seaboard Marine as defendants. Chrysler breached their duty in the design, manufacture, assembly, testing, marketing and sales of the 1997 Jeep Cherokee. The suit filed in the Circuit Court of the Eleventh Judicial Circuit in and for Dade County does not specify an amount of monetary damages being sought. Consumers should beware. There are countless Jeep vehicles on the road, and this is something that occurred, but did not have to had the manufacturer and dealer worked cooperatively to make it safe. However, it would seem that profits are the prevailing motivation rather than safety. In addition to providing at least financial relief to the family, we hope that it will bring attention to the safety issues still at hand with this particular year and model of Chrysler-Jeep vehicle. The loss of one life due to a company's disregard for public and consumer safety is one too many I believe. I think that most people purchasing cars will agree with that theory as well. |
