For Immediate Release - August 20, 2007 Tragic accident leaves talented artist unable to workPALM BEACH COUNTY, Fla (August 17, 2007).- On December 15, 2003, West Palm Beach resident Terry Williams was driving southbound on I-95 in Palm Beach Gardens when he was struck from behind (rear-ended) by a Loomis & Fargo, Co. ("Loomis & Fargo") truck driven by Joel Schwartzberg. "Loomis & Fargo had the duty to ensure that its drivers were continually trained in safe driving tactics," said Theodore J. Leopold, Williams' attorney and managing partner in the Palm Beach Gardens consumer justice firm of Ricci~Leopold, P.A."This responsibility was clearly neglected in the case of Mr. Schwartzberg. If only Mr. Schwartzberg and his employer, Loomis & Fargo, had exercised reasonable care, Terry Williams would be living a full and productive life today." As a result of Schwartzberg's negligence, Williams suffered a severe neck and brain injury. "These injuries have had a devastating affect on not only Terry, but his family an his career as well. What will it take for companies like Loomis & Fargo to begin taking responsibility for their negligence and the action of their employees? How many people have to come into harm's way and suffer severe injuries and lose their livelihoods", Leopold added. Leopold seeks only restitution for the severe injuries that have occurred to Terry and his family and nothing else. "The Williams look forward to their day in court so that a full measure of justice can be obtained", expounded Leopold. The case will go to trial in November in front of Judge John Hoy. Theodore J. Leopold is managing partner in the law firm of Ricci~Leopold, P.A. The # # # |
